PROYECTO DE LEY 064 DE 2012 CÁMARA.
por medio de la cual se expide la Ley de Servicios Sociales y se dictan otras disposiciones.
TÍTULO I
DISPOSICIONES GENERALES
Artículo 1°. Objeto. El propósito de este proyecto de ley es garantizar la prestación de los servicios sociales en condiciones de calidad y equidad en Colombia.
Artículo 2°. Servicio social. Este proyecto de ley regula las prestaciones y acciones afirmativas dirigidas a promover las condiciones materiales y las redes sociales que permiten el libre ejercicio de las capacidades individuales básicas y la integración a la comunidad de las personas, familias y poblaciones, cuando la vulnerabilidad o la discriminación, les impiden lograrlaspor sus propios medios. Los servicios sociales son herramientas de la política pública social.
Las personas jurídicas públicas y privadas prestan servicios sociales bajo la inspección, vigilancia y control del Estado.
Parágrafo. De la reglamentación de esta ley se excluyen los servicios sociales de salud, educación, seguridad social en pensiones, riesgos profesionales, trabajo y empleo.
Artículo 3°. Son sujetos de los servicios sociales, preferentemente:
a) Todas las niñas, niños y adolescentes, en especial aquellos que se encuentren en situación de riesgo o afectados por desnutrición;deficiencias en su desarrollo físico o mental, o cuando este sea afectado por condiciones familiares adversas;maltrato o abuso;abandono, ausencia o irresponsabilidad de progenitores en el cumplimiento y garantía de sus derechos;ser víctimas de cualquier tipo de explotación; vivir en la calle; ser víctimas del tráfico de personas, la pornografía y el comercio sexual;trabajar en condiciones que afecten su desarrollo e integridad física y mental;infractores y víctimas del delito; ser hijos de padres que padezcan enfermedades terminales o en condiciones de extrema pobreza; ser migrantes y repatriados, y ser víctimas de desplazamiento, del conflicto armado y de persecución étnica o religiosa.
b) Las mujeres en estado de gestación o lactancia y las madres adolescentes; mujeres en situación de maltrato o abandono, y en situación de explotación, incluyendo la sexual.
c) Adultos mayores en desamparo, incapacidad, marginación o sujetos a maltrato.
d) Personas con algún tipo de discapacidad o necesidades especiales.
e) Indígenas migrantes, desplazados o en situación de vulnerabilidad.
f) Dependientes de personas privadas de su libertad, de enfermos terminales, de alcohólicos o de fármaco dependientes.
g) Personas en situación de indigencia y habitantes de la calle.
h) Alcohólicos y fármaco-dependientes.
i) Repatriados e inmigrantes.
j) Víctimas de la comisión de delitos.
k) Víctimas de desastres naturales.
l) Los demás sujetos considerados en situación de vulnerabilidad y sujetos de acciones afirmativas.
