¿Justicia machista?
Sin duda muchos indicadores incluido el alto índice de impunidad para los crímenes cometidos contra las mujeres en Colombia y que está alrededor del 98%, así lo confirman, al igual que el reciente y valiente testimonio de una mujer que conoce perfectamente las entrañas de la justicia y que lo ha dicho con todas sus letras, tenemos una justicia abiertamente machista en donde sus jueces, en lugar de aplicar la enorme legislación internacional y las normas nacionales que nos protegen, presionan para que se mantenga el statu quo, para que las mujeres desistan, para que se silencien, para que aguanten y en últimas para que concilien las violencias en todas sus formas, desconociendo que se trata de un delito innegociable, de una violación de derechos humanos.
Hablo de la magistrada Stella Conto Díaz, abogada y docente de la Universidad del Rosario, especialista en Derecho Comercial de la Universidad de los Andes, en Derecho de Seguros de la Universidad Javeriana y quien ha sido magistrada del Consejo de Estado y magistrada auxiliar de la Corte Constitucional, integrante de la Comisión de Género de la Rama Judicial, jueza municipal y del circuito, además de otros cargos y quien estos días le habló al país de la violencia psicológica y económica que sufrió por más de 30 años en su casa a cuenta de su esposo.
En una conmovedora entrevista realizada por Cecilia Orozco, publicada por El Espectador, la magistrada Stella Conto deja en evidencia la irrelevancia que tiene para el sistema judicial la violencia contra las mujeres y su inclinación no sólo a minimizar su gravedad, sino su intención manifiesta para callarlas, menospreciarlas y omitir la condición de delito de la violencia intrafamiliar, favoreciendo la conciliación para “liberarse del problema rápidamente”.
La noticia de la magistrada cayó como una bomba para mostrarnos en el espejo una realidad cotidiana y oculta que viven a diario millones de mujeres alrededor del mundo. Aterrados periodistas de distintos medios, interrogaron a la Señora Conto, sobre cómo es posible que una mujer de sus calidades académicas y profesionales pudiera sufrir como cualquier mujer humilde las vejaciones de un hombre que la acorraló mediante la violencia psicológica y económica, como si aquello fuera una novedad. Como si no no supiéramos que se volvió casi “costumbre” -arraigada en nuestra cultura machista- que hombres de todos los pelambres, estratos sociales y contextos sicoeconómicos se ensañen a diario contra de las mujeres.
Medicina Legal señaló que el año pasado, 128 mujeres fueron asesinadas por compañeros sentimentales o exparejas, y otras 32 por algún familiar. Las cifras de violencia de pareja incluidas en Forensis ,indican que el Instituto atendió 50.707 casos en 2016; 3.500 más que en 2015. Las mujeres que fueron víctimas en 86% de los casos, señalaron que los principales factores desencadenantes de las violencias son en su orden: El machismo (47%), los celos (36%) y el consumo de alcohol y drogas (16). Es de anotar que Medicina Legal reconoce que existe un alto índice de subregistro.
En este caso la sentencia de la Corte Suprema de Justicia reivindica la necesidad no sólo de proteger y reparar a las mujeres, independientemente de sus ingresos, posición económica o laboral, sino que obliga a protegerla y eliminar las brechas de género “Refulge la necesidad de otorgar la protección rogada, pues la omisión (en este caso del Tribunal que falló el caso anterior a la tutela) mantiene impune la violencia comprobada sufrida por la hoy promotora (Stella Conto) a manos de su ex -pareja, sometiéndola a una segunda victimización por la falta de una solución eficaz a su problemática por parte de la administración de justicia”, dice el fallo.
El éxito personal y jurídico de Stella Conto es un hito no sólo para esta cultura machista que encubre, invisibiliza y subvalora la violencia contra las mujeres, sino que marca un nuevo derrotero en la lucha de las mujeres por acceder a la justicia. Tendrán los jueces y hay que decirlo, las juezas, a fuerza de jurisprudencia acatar que las mujeres en nuestra condición de víctimas, somos sujetos de protección y reparación, independiente de la situación socio económica y que en justicia como cualquier ser humano tenemos todo el derecho a vivir una vida libre de violencias, en especial en nuestras casas.
