Anuncio del Presidente Duque pone en riesgo independencia de la Defensoría del Pueblo: congresistas Ángela María Robledo e Iván Cepeda
Bogotá, D.C., febrero 05 de 2020.- Los congresistas Ángela María Robledo e Iván Cepeda, enviaron al Defensor del Pueblo, Carlos Camargo, una petición en la que le manifiestan su preocupación y piden claridad ante el anuncio realizado por la Presidencia de la República en la que advierte que “habrá una metodología única de análisis, que tendrá como base fundamental las cifras que reposan en la Fiscalía y su capacidad investigativa”, y por los anuncios de la Fiscalía General de la Nación al establecer que solo esta entidad podrá contar con funcionarios en terreno para documentar las circunstancias y el contexto de crimenes en el país.
Robledo y Cepeda, le solicitaron a Camargo que aclare si ésta entidad, continuará realizando de manera autónoma e independiente, el registro y consolidación de una base de datos de conductas que atentan contra personas defensoras de derechos humanos, así como contra líderes y lideresas sociales, y si seguirá informando de manera periódica los resultados del ejercicio de registro y consolidación de agresiones a estos mismos sectores.
En la petición, los legisladores le preguntan cuál será la labor de la Defensoría del Pueblo en el proceso de unificación de información relacionada con los crímenes de líderes sociales en el país, anunciado por el Presidente de la República, y si esta entidad continuará cumpliendo con las funciones relacionadas con la verificación y procesamiento de los escenarios de riesgo de violaciones de los Derechos Humanos e infracciones al Derecho Internacional Humanitario.
Advierten los Congresistas al Defensor Camargo, que renunciar a la documentación de agresiones a líderes y lideresas sociales por petición de otra entidad del Estado, e incluso por solicitud del poder Ejecutivo, socaba su independencia y autonomía y significaría una inminente amenaza a la separación de poderes.
“Sin duda el asesinato sitemático y generalizado de líderesas y líderes sociales no se va a resolver en Colombia reduciendo de manera formal las cifras de estos asesinatos. Ocultar ese gravísimo problema ayuda a crear un ambiente propicio para establecer un Estado de opinión en el que siga produciéndose estos asesinatos, tanto de líderes sociales como de excombatientes” dijo Iván Cepeda.
Para la Representante a la Cámara, Ángela María Robledo, la unificación de cifras y metodología para la documentación de agresiones a líderes sociales en cabeza de la Fiscalía significa “no solo desconocer la valiosa labor que viene desarrollando la Defensoría del Pueblo, con el sistema de Alertas Tempranas, desconocer también el trabajo de organizaciones sociales, como “Somos Defensores” e “Indepaz” entre otras, que cada día hacen seguimiento y documentan todo tipo de hechos victimizantes, sino minimizar la magnitud del problema de asesinatos y vulneraciones a los Derechos Humanos de líderes, lideresas sociales y defensores/as”.
“El anuncio de la Presidencia, pone en riesgo la autonomía e independencia de la Defensoría del Pueblo, entidad que ha cumplido un importante trabajo en el monitoreo de las violaciones a los derechos humanos. Su tarea de acompañamiento y de verificación en los territorios más alejados comprende una función humanitaria invaluable en estos lugares, en donde la representación institucional se ha visto limitada”, concluyó Iván Cepeda.
